2024 NFL Season – Buccaneers Parking Terms
The parking pass ("Parking Pass") is a revocable license for the Parking Pass holder, and any accompanying minors, invitees, guests and passengers (collectively "Holder") to enter an authorized parking facility at or adjacent to Raymond James Stadium ("Stadium") and occupy one parking space during the designated Tampa Bay Buccaneers game and related events (the "Event"). The Parking Pass may be revoked at any time and for any reason in the sole discretion of the Tampa Sports Authority ("TSA") or the Tampa Bay Buccaneers ("Buccaneers"), and each of their respective employees, officers, directors, owners, members, agents, or contractors (collectively, the "Management"). Holder agrees that this Parking Pass is subject to these terms and conditions ("Terms") and by using this Parking Pass for the Event, Holder is deemed to have read the Terms, understands them, and agrees to be bound by them.
No refund or remedy will be provided if the Parking Pass is revoked due to (i) Holder's disorderly conduct, or (ii) Holder's breach of Stadium policies or parking rules, including these Terms. If the Parking Pass is revoked for any other reason, THE SOLE AND EXCLUSIVE REMEDY is an account credit or refund of up to the amount Buccaneers received for the sale of the Parking Pass for the Event, as determined by Buccaneers. Once Holder presents the Parking Pass and enters the parking facility, the Parking Pass is deemed used, and Holder will not be entitled to a refund if the Event is canceled or terminated early for any reason. Management's liability for any breach of any these Terms shall not exceed the amount Buccaneers received for the sale of the Parking Pass for the Event, as determined by Buccaneers in its sole discretion. IN NO EVENT SHALL HOLDER OR ANYONE CLAIMING THROUGH HOLDER OR ON HOLDER'S BEHALF BE ENTITLED TO (1) ANY SPECIAL, CONSEQUENTIAL, INCIDENTAL, INDIRECT OR EXEMPLARY DAMAGES OF ANY KIND, INCLUDING ANY AMOUNT PAID FOR THIS PARKING PASS TO A THIRD PARTY IN EXCESS OF THE AMOUNT MANAGEMENT RECEIVED FOR THE SALE OF THE PARKING PASS FOR THE EVENT, AS DETERMINED BY MANAGEMENT; (2) REIMBURSEMENT OF ANY TRAVEL-RELATED EXPENSES; OR (3) ANY DELAY CAUSING YOU TO ARRIVE LATE OR MISS THE EVENT FOR ANY REASON.
The Parking Pass receipt, if provided, must be prominently displayed on Holder's vehicle dashboard at all times. Attendants, law enforcement, or other security personnel (collectively, "Parking Attendants") may instruct Holder where to park ("Directed Parking") and may provide other directions regarding entering and exiting the parking facility. Holder agrees to follow the Parking Attendants' instructions and all directional parking signs in or around the parking facility. Parking Attendants are not authorized to make or allow any exceptions to these Terms. The Parking Pass is valid for Directed Parking only, and not for a reserved parking space. Holder may be relocated, without remedy or refund, to an alternate parking location with a comparable value as determined in Management's sole discretion.
Holder may not display commercial signage, and/or commercial markings on or around vehicles or the parking facilities. Holder may not use the Parking Pass or enter the parking facility for advertising, promotion or any other commercial purposes (including contests, sweepstakes and giveaways) without Buccaneers' and/or NFL's express written consent. Use, operation, deployment, or monitoring of any unmanned aerial vehicle or similar device is prohibited in or near parking facilities or the Stadium. Any recording, photograph, video, or other content related to an Event obtained through the use of such unmanned aerial vehicle or similar device is prohibited and subject to confiscation.
Holder must at all times adhere to the Fan Code of Conduct (https://raymondjamesstadium.com/policies-procedures) and be courteous to those around you. Keep drive lanes clear at all times. Personal belongings, including chairs and grills, may not be placed in adjacent parking spaces. Holder may not litter or commit any nuisance or other act that may disturb the quiet enjoyment or safety of others in the parking facility. Please keep music at a reasonable volume; audio should not be heard beyond 50 feet of Holder's vehicle and shall not disturb other Event guests. Holder is responsible for its own conduct and that of Holder's invitees, guests, and any passenger arriving in the vehicle associated with this Parking Pass, including any accompanying minors. Holder is prohibited from leaving pets or other animals unattended in a vehicle, and Holder assumes the risk of any damage caused as a result of extricating any pet or other animal from the vehicle.
Resale of Parking Passes is prohibited. Violation of these resale restrictions may result in automatic termination of this license and admission refused for the resold Parking Pass without refund.
No bailment is created by tendering a parking fee, entering the lot, or parking at the facility.
Holder's use of wireless Internet in and around the Stadium and parking facility ("RJSWiFi") is subject to the WiFi Terms and Acceptable Use Policy which can be found at www.buccaneers.com/wifiterms. By accessing, connecting to, and/or using RJSWiFi, Holder accepts and agrees to all such terms and conditions of use.
Any collection, use, and/or disclosure of Holder data in connection with Holder's use of Parking Pass, attendance at the Event, or use of the websites, mobile applications, and other online or offline services of the NFL or the Buccaneers, including without limitation use of RJSWiFi (the "Services"), are subject to the Buccaneers Privacy Policy located at https://www.buccaneers.com/team/privacy-policy, which provides greater detail on how Holder personal information may be used and how to exercise any rights Holder might have under applicable law. By using the Services, Holder acknowledges that they have read and understood the terms of the Buccaneers' Privacy Policy.
ASSUMPTION OF RISK. HOLDER KNOWINGLY AND VOLUNTARILY ASSUMES ALL RISKS, HAZARDS AND DANGERS incident to entering, exiting or parking in the facility, including without limitation, the risk of contracting a communicable disease or illness (including exposure to a bacteria, virus, or other pathogen capable of causing a communicable disease or illness), the risk of personal injury, fire, theft, damage, or loss of Holder's vehicle or any contents, and hereby waives any and all claims or potential claims arising from such risks, damage or injuries. NOVEL CORONAVIRUS SARS-COV-2 (TOGETHER WITH ANY VARIANT THEREOF, "COVID-19") IS AN EXTREMELY CONTAGIOUS DISEASE THAT CAN LEAD TO SEVERE ILLNESS AND DEATH. THE CDC ADVISES THAT SENIOR CITIZENS AND THOSE WITH UNDERLYING MEDICAL CONDITIONS ARE ESPECIALLY VULNERABLE. AN INHERENT RISK OF EXPOSURE TO COVID-19 EXISTS IN ANY PLACE WHERE PEOPLE ARE PRESENT. BY ENTERING THE STADIUM GROUNDS, HOLDER VOLUNTARILY ASSUMES ALL RISKS RELATED TO EXPOSURE TO COVID-19.
RELEASE, WAIVER AND COVENANT NOT TO SUE. On behalf of Holder and Holder's Related Persons (defined below), on whose behalf Holder represents it has the authority to act with respect to this Parking Pass and the matters herein, Holder KNOWINGLY AND VOLUNTARY RELEASES, WAIVES, and COVENANTS NOT TO SUE each of the Released Parties (defined below) with respect to any and all claims including for negligence and/or wrongful death that Holder or any of Holder's Related Persons may have (or hereafter accrue), against any of the Released Parties, that relate to any of the risks, hazards and dangers described in the preceding paragraph, including without limitation any and all claims and damages of any kind or character that arise out of or relate in any way to Holder's (i) entry into, or presence within or around, the parking facility or compliance with any protocols applicable to the Event; or (ii) any interaction between Holder and any personnel of any of the Released Parties present in or around the parking facility or at the Event, or (iii) exposure to any communicable disease including COVID-19 or any variant thereof, in each case whether caused by any action, inaction or negligence of any Released Party or otherwise. Holder further represents and warrants that Holder's Related Persons have reviewed these Terms and separately agreed to them. TO THE EXTENT THAT HOLDER OR ANY HOLDER'S RELATED PERSONS, OR PERSONS WHO CLAIM THAT THEY CONTRACTED A COMMUNICABLE DISEASE, INCLUDING COVID-19, OR ANY VARIANT THEREOF FROM HOLDER OR HOLDER'S RELATED PERSONS, FILE A CLAIM, SUIT OR ARBITRATION AGINST ANY OF THE RELEASED PARTIES ARISING FROM OR RELATING TO THESE TERMS OR THE EVENT, HOLDER HEREBY AGREES TO FULLY INDEMNIFY AND HOLD HARMLESS THE RELEASED PARTIES AGAINST SUCH CLAIM, SUIT OR ARBITRATION TO THE FULLEST EXTENT PERMITTED BY LAW. IT IS ACKNOWLEDGED AND AGREED THAT THE RELEASED PARTIES ARE USING COMMERCIALLY REASONABLE EFFORTS TO ENSURE AND ENFORCE COMPLIANCE WITH APPLICABLE CDC GUIDELINES AND STATE AND LOCAL LAWS FOR PROTECTION AGAINST COVID-19 OR ANY VARIANT THEREOF ("COVID-19 BEST PRACTICES"), HOWEVER, NOTWITHSTANDING, HOLDER AGREES TO RELEASE, DISCHARGE, INDEMNIFY AND HOLD HARMLESS THE RELEASED PARTIES FOR ANY FAILURE OF THE RELEASED PARTIES TO ENSURE OR ENFORCE ANY COVID-19 BEST PRACTICES. HOLDER UNDERSTANDS THAT THEY ARE RELEASING AND WAIVING CERTAIN POTENTIAL RIGHTS HELD BY HOLDER.
As used herein:
- "Related Persons" means Holder's heirs, assigns, executors, administrators, next of kin, anyone attending the Event with Holder, including but not limited to minors for whom Holder is a parent or guardian (which persons Holder represents have authorized Holder to act on their behalf for purposes of the release herein), and other persons acting or purporting to act on Holder's or their behalf.
- "Released Parties" means: (i) Buccaneers Team LLC, Buccaneers Stadium LLC, Tampa Sports Authority, RJS Stadium, A Commercial Condominium Association, Hillsborough County, the City of Tampa, NFL Ventures, Inc., NFL Ventures, L.P., the National Football League and its other professional member clubs, and each of their respective direct and indirect affiliates, administrators, designees, licensees, agents, owners, officers, directors, general partners, partners, members, employees, contractors (and all employees of such contractors) and other personnel; (ii) the direct and indirect owners, lessees and sublessees of the Stadium and related stadium grounds (including, without limitation, parking areas and entry gates); (iii) all third parties performing services at the Stadium and related Stadium grounds (including, without limitation, parking areas and entry gates), including but not limited to Legends Hospitality, LLC, Fanatics Retail Group Concessions, LLC, Sentry Event Services, Inc, Performance Clean, LLC, and Park Jockey; and (iv) any parents, subsidiaries, affiliated and related companies and officers, directors, owners, members, managers, partners, employers, employees, agents, contractors, sub-contractors, insurers, representatives, successors and/or assigns of each of the foregoing entities and persons, whether past, present or future and whether in their institutional or personal capacities.
Management is not responsible for lost, stolen, destroyed, or counterfeit Parking Passes, as well as Parking Passes sold in violation of any applicable law, and may refuse to honor them. To the extent that duplicates of the same Parking Pass can be created, only the first Parking Pass presented will be valid for admission to the parking facility; Parking Passes with barcodes that have already been scanned are not valid for admission to the parking facility.
ARBITRATION; JURY TRIAL WAIVER; CLASS ACTION WAIVER; CHOICE OF LAW AND TORT CLAIM FORUM SELECTION. FLORIDA LAW, WITHOUT REGARD TO CONFLICT OF LAW PRINCIPLES, GOVERNS THESE PARKING TERMS AND ANY CONTROVERSY OR CLAIM ARISING OUT OF OR IN ANY WAY RELATING TO THESE PARKING TERMS, OR BREACH THEREOF, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE CLAIMS OR OTHER TORT CLAIMS OF ANY KIND, STATUTORY CLAIMS OF ANY KIND OR ANY OTHER CLAIMS FOR RELIEF UNDER ANY OTHER LEGAL THEORIES.
EXCEPT AS EXPRESSLY PROVIDED HEREIN, ALL CLAIMS IN ANY WAY RELATING TO OR ARISING FROM THESE PARKING TERMS, OR HOLDER'S ENTRY INTO THE STADIUM PARKING AREAS SHALL BE RESOLVED BY BINDING ARBITRATION ADMINISTERED BY JAMS WITH A PANEL OF THREE (3) ARBITRATORS UNDER ITS COMPREHENSIVE ARBITRATION RULES AND PROCEDURES, AND JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF. SUCH ARBITRATION SHALL ADHERE TO JAMS' MINIMUM STANDARDS FOR ARBITRATION PROCEDURES, REMAIN CONFIDENTIAL, AND BE HELD IN TAMPA, FLORIDA. REGARDLESS OF WHERE HOLDER RESIDES OR FROM WHERE HOLDER PURCHASED THEIR TICKET.
NOTWITHSTANDING THE FOREGOING, ANY TORT OR TORT-RELATED CLAIM (INCLUDING BUT NOT LIMITED TO NEGLIGENCE CLAIMS AND STATUTORY CLAIMS) IN ANY WAY RELATING TO OR ARISING FROM THESE TERMS, OR HOLDER'S ENTRY INTO THE STADIUM PARKING AREAS SHALL BE LITIGATED IN A COURT OF COMPETENT JURISDICTION IN HILLSBOROUGH COUNTY, FLORIDA. EACH PARTY WAIVES THE RIGHT TO A JURY TRIAL. FURTHER, EACH PARTY WAIVES THE RIGHT TO A COURT TRIAL WITH RESPECT TO NON-TORT CLAIMS HEREUNDER.
EACH PARTY AGREES THAT THEY WILL RESOLVE ALL DISPUTES ON AN INDIVIDUAL BASIS. THE PARTIES WAIVE ANY RIGHT TO ASSERT ANY DISPUTE AGAINST ANY OTHER PARTY AS A REPRESENTATIVE OR MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION, WHETHER DURING BINDING ARBITRATION, OR LITIGATION, EXCEPT WHERE SUCH WAIVER IS PROHIBITED BY LAW OR DEEMED BY A COURT OF COMPETENT JURISDICTION CONSTRUING THESE TERMS TO BE AGAINST PUBLIC POLICY AND ANY RIGHTS TO PARTICIPATE IN, AND AGREES NOT TO PARTICIPATE IN, ANY CLASS ACTION, REPRESENTATIVE ACTION, CLASS ARBITRATION, CONSOLIDATED ARBITRATION OR COURT PROCEEDING, OR ANY SIMILAR PROCEEDING, WITH RESPECT TO ALL CLAIMS HEREUNDER.
THE PREVAILING PARTY IN ANY PROCEEDING RELATING TO OR ARISING FROM HOLDER'S ENTRY INTO THE STADIUM PARKING AREAS SHALL BE ENTITLED TO RECOVER ITS ATTORNEYS' FEES AND COSTS, INCLUDING THE COSTS OF ARBITRATION OR LITIGATION AS THE CASE MAY BE, FROM THE OTHER PARTY TO THE FULLEST EXTENT PERMITTED BY LAW.
NOTICE TO THE MINOR CHILD'S NATURAL GUARDIAN
READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF THE RELEASED PARTIES USE REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY ENTERING THE PARKING FACILITY, YOU ARE GIVING UP YOUR CHILD'S RIGHT AND YOUR RIGHT TO RECOVER FROM THE RELEASED PARTIES IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND MANAGEMENT HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IN THE ACTIVITY IF YOU DO NOT SIGN THIS FORM.
Holder agrees that by use of the parking pass and entry into the parking facility and related Stadium grounds, it shall be construed that Holder has read and consented to accept these Terms with the same force and effect as if Holder signed these Terms, including but not limited to, the form waiving and assuming the risk of inherent risks on behalf of a minor child.
If any provision of these Terms is determined to be invalid or unenforceable, such provision will be amended to the minimum extent necessary to make such provision enforceable and the remainder of these Terms will not be affected, but will continue to be valid and enforceable to the fullest extent permitted by law.
IF HOLDER ON BEHALF OF HIMSELF/HERSELF OR ANY RELATED PERSONS, OR ANY OF HOLDER'S RELATED PERSONS DO NOT CONSENT TO ALL OF THE TERMS IN ALL PARAGRAPHS SET FORTH HEREIN, SUCH PERSON MUST LEAVE AND NOT ENTER THE PARKING. BY ENTERING ANY OF THE PARKING AREA, HOLDER AND HOLDER'S RELATED PERSONS AGREED TO THESE TERMS.
